Title 42 › CHAPTER 7 — SOCIAL SECURITY › SUBCHAPTER IV — GRANTS TO STATES FOR AID AND SERVICES TO NEEDY FAMILIES WITH CHILDREN AND FOR CHILD-WELFARE SERVICES › Part E — Federal Payments for Foster Care, Prevention, and Permanency › § 679b
The Secretary must work with Governors, state lawmakers, state and local child welfare officials, and advocates to create clear outcome measures to judge how well States run child protection and child welfare programs. Examples include length of time in foster care, number of placements, and number of adoptions. The Secretary should use data from the Adoption and Foster Care Analysis and Reporting System when possible. The Secretary must make a system to rate each State on those measures, explain how the ratings are calculated, and require States to send the needed data as a condition of getting money. On May 1, 1999, and every year after, the Secretary must send Congress a report showing each State’s results, why States did well or poorly, and, when possible, suggestions for improvement. Beginning with fiscal year 2007, the annual report must include State-by-State data on monthly caseworker visits: the percent of children visited each month, how the total visits compare to the number that would happen if every child were visited once a month, and the percent of visits that happened in the child’s home. Beginning with fiscal year 2016, the report must also include State-by-State details about children placed in non‑family settings (type of setting, number and basic demographics of children, length of placement, prior placements, special needs, services provided, and how many have a permanency plan of “another planned permanent living arrangement”) and data on children in foster care who are pregnant or parenting. The Secretary must also consult with States and child welfare groups and consider requests from Members of Congress when picking other topics to study, using data from AFCARS and the National Youth in Transition Database.
