Title 42 › CHAPTER 82 — SOLID WASTE DISPOSAL › SUBCHAPTER III — HAZARDOUS WASTE MANAGEMENT › § 6936
Owners or operators of certain waste piles, landfills, and surface impoundments that are allowed to operate must use liners and liquid-collection systems that meet the technical rules the Administrator set before October 1, 1982 or later revised under the minimum-technology rules. These rules apply to any new unit, to replacing a unit, and to any sideways (lateral) expansion that is inside the waste area named in the permit application. The rules also apply to waste that the unit begins to receive six months after November 8, 1984. For landfills and impoundments, the owner must tell the agency in charge (or the State) at least 60 days before receiving waste. After that notice, the agency must require the owner to file a permit application within six months. If a unit already has a liner and liquid-collection system installed in good faith under these rules, the agency generally cannot force a different system when it issues the first final permit, unless it has reason to believe the installed liner is leaking. The agency may change the liner and collection rules later to improve protection.
