Title 42 › CHAPTER 82 — SOLID WASTE DISPOSAL › SUBCHAPTER III — HAZARDOUS WASTE MANAGEMENT › § 6939g
Set up a nationwide electronic system to track hazardous waste shipments. The EPA Administrator must create the system within 3 years after October 5, 2012. The system can be used by waste generators, transporters, facilities, or anyone else who must use a hazardous waste manifest and who chooses to file electronically or submits paper manifests for processing. Board — an advisory group for the system. Fund — a special Treasury account for user fees. Person — any individual or organization. System — the electronic manifest system. User — anyone who must use a manifest and uses the system or sends paper copies for processing. The EPA may charge users reasonable fees to pay for building, running, and upgrading the system. Fees must be collected and put into the Fund. The EPA will set fee rules with contractor input and can raise or lower fees so the Fund covers costs but does not grow too large. An extra $2,000,000 may be allowed to build up in the first 3 years of operation. Money from the Fund is handled under appropriations rules. The EPA must report financial accounts every two fiscal years and the Inspector General must audit the Fund and report yearly. The EPA may hire contractors (after talking with Transportation) for up to 10 years to build and run the system. The contract should be based on performance and how well the system serves users. The Federal Government keeps ownership of the system. The EPA must create rules within 1 year after October 5, 2012, to move from paper to electronic manifests and to allow States and the public appropriate access. When a State requires a manifest, the receiving facility must fill in its part, sign and date the certification, and send a final copy to the system. Up to $2,000,000 is authorized for each fiscal year 2013, 2014, and 2015 for start-up, and these amounts are to be offset by user fees.
