Title 42 › CHAPTER 82 — SOLID WASTE DISPOSAL › SUBCHAPTER IV — STATE OR REGIONAL SOLID WASTE PLANS › § 6944
The EPA Administrator must issue rules within one year after October 21, 1976. Before issuing them, the Administrator must talk with the states and hold public notice and hearings. The rules will decide what is a sanitary landfill and what is an open dump. A site can be called a sanitary landfill only if it is not likely to harm people’s health or the environment. The rules can also group different kinds of sanitary landfills. Each state plan must ban open dumps and require all solid waste be disposed in ways that meet the federal disposal requirements. That ban begins six months after the EPA issues the rules.
