Title 42 › CHAPTER 82 — SOLID WASTE DISPOSAL › SUBCHAPTER IV — STATE OR REGIONAL SOLID WASTE PLANS › § 6947
The Administrator must approve or disapprove a State plan within six months after the plan is sent in. The plan can be approved only if it meets the required plan elements and if it promises to revise the plan, after public notice and a hearing, when federal rules change, new information shows the plan is not working, or other changes are needed. The Administrator will check approved plans from time to time and can withdraw approval after notice and a hearing if the plan no longer meets the minimum rules. The withdrawal ends when the plan is brought back into compliance. The Administrator will give federal money to a State if the State and its local authorities met earlier required deadlines and the State has an approved plan. For fiscal years 1978 and 1979, grants will be made if the plan is still eligible and is being carried out. If approval is pulled, federal money and technical help will be stopped except for limited help to regain approval. Current State, regional, or local solid waste activities may continue unless they conflict with an approved State plan.
