Title 42 › CHAPTER 82 — SOLID WASTE DISPOSAL › SUBCHAPTER VII — MISCELLANEOUS PROVISIONS › § 6973
Gives the Administrator the power to sue people who have handled, stored, treated, transported, or disposed of solid or hazardous waste when there is evidence that the waste may cause an immediate and serious danger to people or the environment. The Administrator can ask a court to make those people stop the harmful actions and can order them to take other steps needed to protect health and the environment. A transporter is not treated as a contributor for harm that happens after the waste left their control if the shipment was under a sole contractual arrangement from a published tariff, accepted for carriage by a common carrier by rail, and the transporter used due care. The Administrator must tell the affected State and may take other actions after giving notice. Anyone who willfully ignores an Administrator’s order can be fined up to $5,000 for each day the violation continues. If there is hazardous waste that poses an immediate danger, the Administrator must quickly notify local government agencies and require a notice to be posted at the site. Before the United States or the Administrator agrees not to sue or settles a claim under this authority, the public in the affected area must get notice, a chance for a meeting, and a chance to comment. The choice to enter or not enter such a settlement is not a final agency action that can be reviewed by courts under this chapter or chapter 7 of title 5.
