Title 42 › CHAPTER 82 — SOLID WASTE DISPOSAL › SUBCHAPTER VIII — RESEARCH, DEVELOPMENT, DEMONSTRATION, AND INFORMATION › § 6986
The Administrator can give money to a State, city, or regional agency to test resource recovery systems or to build new or better solid waste disposal sites. For tests, projects must follow approved solid waste plans and federal guidelines, be planned for a whole service area, and share costs fairly. The federal share for these demonstration projects can be up to 75%. For building or improving disposal facilities, the area must have an adopted state or regional plan, the site must fit into a satisfactory comprehensive plan and federal guidelines, and the project must use improved methods to lessen environmental harm or recover energy, materials, or resources. The federal share for construction is up to 50% if the project serves only one city, and up to 75% otherwise. The Administrator must create rules for awarding grants that include serving different sizes of communities and setting deadlines. When choosing projects, the Administrator will consider public benefits, whether the project can make money or be practical, if it could help other communities, and whether the applicant uses regional planning. Grants will only pay the federal share of estimated design and construction costs, and for demonstrations also the first year’s operation costs. Grants cannot pay for land or ongoing operations (unless the demonstration rule applies), and applicants must show how they will run and maintain the project. No more than 15% of annual funds can go to projects in any one State.
