Title 42 › CHAPTER 84 — DEPARTMENT OF ENERGY › SUBCHAPTER II — ESTABLISHMENT OF DEPARTMENT › § 7135
Creates an Energy Information Administration (EIA) inside the Department of Energy and puts an Administrator in charge. The President must appoint the Administrator with Senate approval, and the pay is at Executive Schedule level IV (section 5315 of title 5). The Administrator must be professionally qualified and must run a central program to collect, check, analyze, and publish data about energy reserves, production, demand, technology, and related economic and statistical information. The Secretary may delegate the Department’s energy information duties to the Administrator, and the Administrator may act in the Secretary’s name to carry out and enforce those duties. The Administrator may collect and analyze information and publish technical or statistical reports without needing approval from other Department or federal officers. The EIA must have an annual professional audit as described in section 55 of part B of the Federal Energy Administration Act of 1974. The Administrator must share information with other offices in the Department on request. Collected data must be cataloged and made available to the public on request, except for items exempt from disclosure under section 552(b) of title 5, and other statutory confidentiality rules continue to apply. The Administrator must identify “major energy-producing companies” and design a uniform financial report format (effective the second full calendar year after August 4, 1977) so company data can be compared. Major companies must file annual reports and may be asked quarterly when needed. The EIA must run several surveys: manufacturing energy use at least every four years; residential and commercial use at least every four years; annual renewable electricity production; and a monthly renewable motor fuels survey (with five years of prior data). Definitions in this part: energy-producing company (companies doing exploration, extraction, processing, storage, generation, transport, or distribution of energy), energy industry (all such companies), and person (as defined in section 796 of title 15).
