§7136 Economic Regulatory Administration; Appointment of Administrator; Compensation; Qualifications; Functions

Summary

Creates an Economic Regulatory Administration inside the Department, led by an Administrator appointed by the President and confirmed by the Senate. The Administrator is paid at the Level IV rate of the Executive Schedule (section 5315 of title 5) and must have proven ability, background, training, or experience to fairly weigh the needs and concerns of all groups affected by Federal energy policy. The Secretary must make rules that keep the Administration’s regulatory work separate from its enforcement work. Under subchapter IV, the Secretary must use the Administration to carry out whatever functions the Secretary finds appropriate.
