Title 42 › CHAPTER 84 — DEPARTMENT OF ENERGY › SUBCHAPTER V — ADMINISTRATIVE PROCEDURES AND JUDICIAL REVIEW › § 7191
Federal rule-making procedures must be used for rules, regulations, or orders made by the Secretary or by other Department officers, and for state or local rules the Secretary has authorized. If a law moved into this Department adds extra procedure requirements, those extra steps must be followed too. The same procedures apply to the Commission when it does the jobs described in section 7172(c)(1) or work the Secretary gave it under section 7172(e). If the Secretary finds a proposed rule has no big factual or legal questions and won’t likely affect the national economy or many people or businesses, the normal notice-and-comment process under section 553 of title 5 can be used. If the rule raises big issues or likely big impacts, people must be given a chance to speak in person and a transcript must be kept. Anyone who would be hurt by the rule can ask for that in-person chance. The Secretary can skip the in-person step only if following it would likely cause serious harm to public health, safety, or welfare, and must say so in detail and fix the missed steps soon after. If a rule mainly affects just one local government, one area inside a State, or one State, hearings or in-person presentations should, when appropriate, be held inside that area. The Secretary may also write special procedures for state or local agencies carrying out these functions; those procedures must give notice to affected people and let them present their views before action.
