Title 42 › CHAPTER 85 — AIR POLLUTION PREVENTION AND CONTROL › SUBCHAPTER I — PROGRAMS AND ACTIVITIES › Part D — Plan Requirements for Nonattainment Areas › subpart 1 — nonattainment areas in general › § 7507
States with approved plans may set and enforce new-vehicle emission rules if those rules are exactly the same as California’s standards that got a waiver for that model year, and if California and the State adopt them at least two years before the model year starts (as the Administrator’s rules say). A State may not block or limit the making or sale of a new vehicle or engine that is certified in California, or force makers to produce a different “third vehicle.”
