Title 42 › CHAPTER 85 — AIR POLLUTION PREVENTION AND CONTROL › SUBCHAPTER III — GENERAL PROVISIONS › § 7624
Owners must pay to buy and install vapor recovery equipment at retail fuel outlets, as defined by the rules. Leases made or renewed after August 7, 1977 cannot make the renter pay those costs. Owners may recover the cost by raising prices on products they sell, even if other laws would say otherwise. The rules can allow a lease to make the renter pay over a reasonable time, but only if the owner does not sell, trade, or dispense any product at that outlet. Who counts as the owner and what is a “reasonable period” are set by the rules.
