Title 42 › CHAPTER 85 — AIR POLLUTION PREVENTION AND CONTROL › SUBCHAPTER V — PERMITS › § 7661d
Permitting authorities must send the EPA Administrator copies of permit applications, major changes, and proposed or final permits when the Administrator asks, and must tell nearby States — those that touch the State where the emissions come from or are within 50 miles of the source — about each application or proposed permit so those States can send written comments. If a permitting authority ignores a State’s recommendations, it must tell that State and the Administrator and explain why. The Administrator has 45 days after getting a proposed permit or the State notice to object in writing and must say why. If the Administrator does not object, any person may petition the Administrator within 60 days after that 45-day period, but the petition must rely on issues raised in the public comment period unless it was impossible to raise them then. The Administrator must decide on the petition within 60 days and may not delegate that duty. If the Administrator objects, the permitting authority cannot issue the permit unless it is fixed. If the authority does not fix it within 90 days, the Administrator will issue or deny the permit. The Administrator can waive these notice rules for some non-major sources and can require action if a permit should be changed, giving the permitting authority 90 days (plus one 90-day extension) to respond.
