Title 42 › CHAPTER 85 — AIR POLLUTION PREVENTION AND CONTROL › SUBCHAPTER VI — STRATOSPHERIC OZONE PROTECTION › § 7671j
The Administrator must make rules for these labels within 18 months after November 15, 1990, and the public gets a chance to comment. Starting 30 months after November 15, 1990, any container holding a class I or class II substance, and any product that contains a class I substance, cannot be sold across state lines unless it has a clear warning that names the substance and says it harms public health and the environment by destroying ozone in the upper atmosphere. For products that contain class II substances, the same label rule applies after 30 months only if the Administrator finds there are available substitutes that don’t use the class II substance and that lower health and environmental risks. Beginning January 1, 2015, all products containing class II substances must have the warning. If a product is made using a class II substance, the product needs the “manufactured with” warning after the same 30-month finding. Products made using class I substances need the warning 30 months after November 15, 1990, unless the Administrator finds no suitable substitutes. From January 1, 2015, labeling applies to all products made with class I or II substances. Anyone may petition the Administrator after 18 months to require labeling for a product; the Administrator must respond within 180 days with a proposal or an explanation, and must issue a final rule within 1 year if proposing. Petitions must include supporting data, and the Administrator can gather needed information. When labeling is required for a product, the rule takes effect 1 year after the decision or 30 months after November 15, 1990, whichever is later. These labels do not shield anyone from other legal liability, and no other agency approval is needed for these specific label rules.
