Title 42 › CHAPTER 91 — NATIONAL ENERGY CONSERVATION POLICY › SUBCHAPTER VII — ENERGY SAVINGS PERFORMANCE CONTRACTS › § 8287c
Defines key words used in this part of the law. Federal agency means any authority of the U.S. Government, even if another agency reviews it. Energy savings means lower costs for energy, water, or wastewater in an existing Federal building based on a contract baseline; it covers things like buying or leasing equipment, upgrades, better operation and maintenance, cogeneration or heat recovery for federal buildings, improved interior or exterior water use, selling extra on-site renewable or cogenerated energy when allowed, using or selling incentives or credits, and any revenue from reduced use or better recycling. Energy savings contract (or energy savings performance contract) means a contract to design, buy, install, test, and, if needed, operate, maintain, and repair one or more energy or water saving measures; contracts for public buildings must follow the prospectus rules in section 3307 of title 40. Energy or water conservation measure means either an energy conservation action defined in section 8259 or a water-saving action that is life-cycle cost-effective and improves water use, recycling, treatment, operations, retrofits, or similar activities (not for a Federal hydroelectric facility).
