§8324 Terms and Conditions; Compliance Plans

Title 42 › CHAPTER 92 — POWERPLANT AND INDUSTRIAL FUEL USE › SUBCHAPTER II — NEW FACILITIES › Part B — Exemptions › § 8324

Last updated Sep 23, 2026|Official source

Summary

The Secretary must set conditions for any exemption. These can require practical fuel-saving steps that match the law’s goals. For temporary exemptions, the conditions (which can include a compliance plan) must make sure the people and powerplant covered follow the rules when the exemption ends. A compliance plan must be approved by the Secretary. It must include a schedule for meeting the rules and proof of binding fuel contracts or fuel-production capacity to make compliance possible. The plan must be updated when the Secretary requires it.
