Title 42 › CHAPTER 92 — POWERPLANT AND INDUSTRIAL FUEL USE › SUBCHAPTER VII — ADMINISTRATION AND ENFORCEMENT › Part A — Procedures › § 8411
Rules made under this chapter must follow the rulemaking steps in section 553 of title 5 unless the chapter says otherwise. Before the Secretary issues a rule or order that bans something, the Secretary must publish the proposed rule or order in the Federal Register, explain why, and, for rules, describe any special circumstances to consider. If a specific powerplant is named, the operator must get a copy. People can file petitions asking for an exemption. Those petitions must follow the form and timing the Secretary sets. The Secretary must publish the petition and its reasons in the Federal Register, allow at least 45 days for public written comments, and had to issue rules for this process by 120 days after November 9, 1978. The Secretary must tell and, where practical, consult the state agencies that regulate the powerplant. A final decision on a petition must come within 6 months after the public comment and hearing period, but the Secretary can extend that date if a notice and reasons are published. For any proposed prohibition or exemption, interested people can give oral testimony at a public hearing and question other speakers, government employees or contractors, and experts, though questioning can be limited to avoid duplication. A hearing transcript must be kept. Any rule or order must be based on the whole record and supported by reliable, probative, and substantial evidence. Copies of proposed prohibitions or exemption petitions (except those under section 8374) must be sent to the EPA Administrator, who should be allowed to comment within the public comment period and to question like other interested persons. Title V of the Department of Energy Organization Act generally does not apply here except as listed in sections 8412(c)(4), 8433(d)(5), and 8434, and these procedures do not apply to actions under section 8374. Other laws change these procedures only if they specifically amend or explicitly say they supersede them.
