Title 42 › CHAPTER 94 — LOW-INCOME ENERGY ASSISTANCE › SUBCHAPTER II — LOW-INCOME HOME ENERGY ASSISTANCE › § 8626
The Secretary must pay each State from its allotted funds, following federal payment rules. Each State must tell the Secretary, no later than 2 months before the end of a fiscal year, how much of its allotment it will not spend that year. If a State wants to ask to keep unspent money for the next year, it must send that request at the same time. The Secretary will not make payments for a year unless the State made that prior-year notice. If by September 1 the Secretary thinks a State will not use some of its allotment, the Secretary will tell the State’s chief executive officer (for example, the governor) and publish a notice. There is a 30-day period for comments and for the State to ask to hold the money for the next year. If the State does not ask to hold it, the amount will be treated as available for reallotment for the next fiscal year. A State’s request to hold money must explain why and say how the money will be used next year. The amount held from a prior year cannot be more than 10 percent of what was payable to the State for that prior year (the payable amount is figured without counting any held money). After considering comments, the Secretary will notify the chief executive officer and publish the decision.
