Title 42 › CHAPTER 96 — BIOMASS ENERGY AND ALCOHOL FUELS › SUBCHAPTER I — GENERAL BIOMASS ENERGY DEVELOPMENT › § 8812
Gives rules for who handles federal money for biomass energy projects. If a project will make less than 15,000,000 gallons of ethanol a year (or the same energy in another form) and does not use aquatic plants, the Secretary of Agriculture is in charge. If it uses aquatic plants or will make 15,000,000 gallons or more a year, the Secretary of Energy is in charge. If a large project (15,000,000 gallons or more) uses wood or wood waste, or is owned and run by a cooperative and does not use aquatic plants, either Secretary may take charge. If one Secretary starts a project under that option, the other must give written agreement before money is given. To decide, the first Secretary must share the application and give the other at least 15 days to review. If the other Secretary objects in writing within 15 days, the decision is delayed 30 days while they try to resolve the issue. If they act together, these review rules do not apply and they decide how to split the funds. Sets time rules for processing applications and who will do the work. Each Secretary must make application rules within 90 days after June 30, 1980, start taking applications within 30 days after those rules, and ask for more applications within 1 year of the first request. Each application must be decided within 120 days after it is received, including any inter-Secretary reviews. Applicants denied help must get a written reason. The Agriculture Secretary may assign the work inside the Department and must tell Congress which unit and officials are in charge within 30 days after June 30, 1980, and may issue rules. The Energy Secretary’s alcohol-related duties are done by the Office of Alcohol Fuels. The two Secretaries must jointly set the energy amount equal to 15,000,000 gallons of ethanol within 30 days after June 30, 1980.
