Title 42 › CHAPTER 99 — OCEAN THERMAL ENERGY CONVERSION › SUBCHAPTER I — REGULATION OF OCEAN THERMAL ENERGY CONVERSION FACILITIES AND PLANTSHIPS › § 9114
When a license application arrives, the Administrator must send a full copy to the Attorney General right away. The Attorney General has 90 days to review antitrust issues and give advice. If he does not send views in 90 days, the Administrator may proceed as if views were received. The Administrator cannot issue, transfer, or renew the license during those 90 days unless the Attorney General says in writing he will not give more advice. Getting a license does not protect anyone from antitrust lawsuits or criminal charges. It also does not take away private rights to sue. The Attorney General and the Federal Trade Commission can still challenge anticompetitive matters in the ownership, building, or operation of an ocean thermal energy conversion facility or plantship.
