Title 42 › CHAPTER 103 — COMPREHENSIVE ENVIRONMENTAL RESPONSE, COMPENSATION, AND LIABILITY › SUBCHAPTER I — HAZARDOUS SUBSTANCES RELEASES, LIABILITY, COMPENSATION › § 9623
Local governments that are directly affected by a release or threatened release at a facility can apply to the President for money to cover emergency actions. The government can pay back costs (from before or after October 17, 1986) for short-term steps to protect people or the environment from hazardous substances, pollutants, or contaminants. Examples include security fencing, fighting fires or explosions, and other immediate local responses. Payments cannot replace money the local government normally spends for responses. Each single response is limited to $25,000. Only the local governments that have jurisdiction where the facility is located may get reimbursement. Payments must follow rules the Administrator made within one year after October 17, 1986.
