Title 42 › CHAPTER 105 — COMMUNITY SERVICES PROGRAMS › SUBCHAPTER II–B — CHILD CARE AND DEVELOPMENT BLOCK GRANT › § 9858e
Requires States that get these child care funds to set aside part of the money each year to improve child care quality and give parents more access to good care. The set‑aside must match the State’s written assessment of needs. For the first and second full fiscal years after November 19, 2014, at least 7% must be reserved. For the third and fourth such years, at least 8% must be reserved. For the fifth and later full fiscal years, at least 9% must be reserved. In addition to those amounts, States must set aside 3% of the funds received by the second full fiscal year after November 19, 2014 and for each full fiscal year after that to improve care for infants and toddlers. A State may reserve more than these minimums. The reserved funds must pay for at least one activity that improves child care. Examples include training and professional development for staff (for child development, behavior supports, nutrition, working with children with disabilities, using data, and help getting college aid); improving early learning guidelines; building or improving a rating system for quality; expanding infant‑toddler programs and training; statewide resource and referral services; help with inspections, licensing, and safety; evaluating program effectiveness; support for voluntary national accreditation; and setting health, mental health, nutrition, and activity standards. Beginning in fiscal year 2016, each State must yearly certify it met these set‑aside rules and explain how the money was used. States must also send an annual report saying how much was reserved, what was done, and how progress will be measured. The federal Secretary will offer technical help if a State asks, but cannot force States to adopt specific quality activities beyond what is required.
