Title 42 › CHAPTER 105 — COMMUNITY SERVICES PROGRAMS › SUBCHAPTER IV — GRANTS TO STATES FOR PLANNING AND DEVELOPMENT OF DEPENDENT CARE PROGRAMS AND FOR OTHER PURPOSES › § 9875
States must apply to the Secretary to get allotments under section 9872. The application must follow the form and deadline the Secretary sets. The governor must sign the yearly application and promise to use the money under the rules of this program. The governor must also say that any Federal funds from section 9873 will be used to add to and increase state, local, and other non-Federal funding for these programs and will never replace those funds. The Secretary cannot tell a State exactly how to meet these promises. As part of the application, the governor must send a written plan showing how the payments from section 9873 will be used and what programs will be supported. The plan must be made public in the State so anyone, including public agencies, can comment during its development and after it is sent. The plan must be updated, if needed, to reflect big changes until September 30, 1991. The plan must include data on children served in before‑and‑after school care, their basic characteristics (age, disability, family income), staff pay and benefits, and clients served by resource and referral systems and the help they requested. Where not inconsistent with this subchapter, certain parts of the Public Health Service Act (section 1903(b); section 1906(a)(1)–(5); and sections 1906(b), 1907, 1908, and 1909) apply here.
