Title 43 › Chapter 25— UNLAWFUL INCLOSURES OR OCCUPANCY; OBSTRUCTING SETTLEMENT OR TRANSIT › § 1062
The U.S. attorney must file a civil case in a federal or territorial court when a U.S. citizen gives an affidavit saying section 1061 is being broken. The affidavit must describe the enclosed land enough to identify it and name or describe the people who control it. The case is brought for the United States in any court that has authority where the land is located. The court can order an injunction to stop the violation. Serving any agent or employee who runs the enclosure is enough. If the court finds the enclosure illegal, it will order it destroyed unless the defendant removes it within five days after the court’s order.
