Title 43 › Chapter 6— WITHDRAWAL FROM SETTLEMENT, LOCATION, SALE, OR ENTRY › § 156
Congress must OK any action, after February 28, 1958, that would set aside, reserve, or limit public land, water, or both for the Department of Defense if doing so would make the total taken for one defense project or facility more than 5,000 acres. This rule also applies to limits on mineral leasing under the Outer Continental Shelf Lands Act, and the 5,000-acre total is counted from February 28, 1958 or from the last law that set land aside for that project, whichever came later.
