Title 43 › CHAPTER 33 — ALASKA NATIVE CLAIMS SETTLEMENT › § 1629
Gives NANA Regional Corporation a land exchange and a long easement so NANA can build and run the Red Dog Mine transportation system under the Terms and Conditions Governing Legislative Land Consolidation and Exchange that the Interior Secretary signed on January 31, 1985 and NANA signed on January 24, 1985. The Secretary will transfer the specific lands listed in that Agreement to NANA in exchange for lands NANA gives up, if NANA does what it promised and accepts the modified exchange within 60 days of September 25, 1985. Only the lands shown as “Amended A(1) Lands” on the “Modified Cape Krusenstern Land Exchange” map dated July 18, 1985 are covered by one part of the swap. Some lands in paragraph A(3) stay federal property but will have the same trail easement treatment as if they had been transferred. Grants NANA a 100-year easement on the “Transportation System Lands” (map dated July 18, 1985) to build, operate, maintain, expand, and reclaim the transportation system under the Agreement’s rules (Exhibit B). The easement ends early if NANA gives it back, if construction does not start within 20 years of September 25, 1985 (excluding force majeure), or when reclamation is finished. The Secretary must sign the easement papers within 90 days after September 25, 1985. NANA may take and sell sand, gravel and similar materials from borrow sites inside the easement and may use materials from Sections 23, 24, 25, 26, 35, and 36 of Township 26 North, Range 24 West, Kateel River Meridian if the Secretary finds that necessary. The National Park Service will monitor work. Anyone may file a written complaint to the Secretary, who must respond in writing within 90 days, and disputes follow the Agreement’s procedures. NANA can limit access to the easement lands but must allow Secretary access for monitoring. The Secretary cannot agree to any amendment to the Agreement without first consulting the House Committee on Natural Resources and the Senate Committee on Energy and Natural Resources and sending them the amendment text when agreeing. Definitions: “The Agreement” = the 1985 land-exchange document; “transportation system” = Red Dog Mine Transportation System; “NANA” = NANA Regional Corporation, Inc.
