Title 43 › CHAPTER 35 — FEDERAL LAND POLICY AND MANAGEMENT › SUBCHAPTER III — ADMINISTRATION › § 1748c
Creates a private, tax-exempt group called the Bureau of Land Management Foundation to take gifts and use them to help the Bureau of Land Management (BLM). The Foundation is not a U.S. government agency and will work on projects that help public lands. It can support education, science, conservation, reclamation, work with wild free-roaming horses and burros, and protect cultural and archaeological sites. A Board of up to nine U.S. citizens will run the Foundation, with the BLM Director as a nonvoting member. Most board members must have relevant experience and should represent different viewpoints. The Secretary had to appoint the first board members within one year after May 5, 2017. Members serve six-year terms, with the first group staggered so one-third serve 2 years, one-third 4 years, and one-third 6 years. Vacancies must be filled within 60 days, and members can be removed for missing three meetings. The chair serves two years. Board members are unpaid but can get travel expenses. The board can adopt bylaws, hire officers once there is enough money, accept and manage gifts or property (and can refuse them), sign contracts, borrow money, and sue or be sued. The Foundation must keep an agent in Washington, D.C. for legal notices, cannot take part in political campaigns, must avoid conflicts of interest, and must send Congress an annual report with its finances. Funds from the Secretary were allowed to help start the Foundation for fiscal years 2017 and 2018 and those funds stay available until spent. Land owned by the Foundation cannot be condemned by a State. The United States is not responsible for the Foundation’s debts, and the Foundation cannot perform duties that the BLM already has by law. Congress may appropriate whatever sums are needed to carry out these rules.
