If a person files a damage claim under this part, the law will assume the damage came from oil and gas exploration, development, or production when the claimant proves four things. The boat was a commercial fishing vessel actively fishing in an area affected by Outer Continental Shelf activities. A report describing where the object that caused the damage was and what the damage was was filed within 15 days after the vessel first returned to port after finding the damage. Nautical charts and the Notice to Mariners that were in effect at least 15 days before the damage did not show that object where the damage happened (but for damage caused by a pipeline, the presumption applies whether or not the pipeline was on those charts). There was no proper surface marker or lighted buoy attached to or closely anchored to the object.
