§2214 Applicable Period of Drought Program

Summary

Programs and authorities under this subchapter start in any Reclamation State and in Hawaii only after the Governor (or, on a reservation, the tribe’s governing body) asks for temporary drought help and the Secretary agrees, or after approval under subchapter II. Governors of Washington, Oregon, Idaho, and Montana must coordinate with the Administrator of the Bonneville Power Administration before asking. All of these authorities end on September 30, 2028.

(a)The programs and authorities established under this subchapter shall become operative in any Reclamation State and in the State of Hawaii only after the Governor or Governors of the affected State or States, or on a reservation, when the governing body of the affected tribe has made a request for temporary drought assistance and the Secretary has determined that such temporary assistance is merited, or upon the approval of a drought contingency plan as provided in subchapter II of this chapter.
(b)If a Governor referred to in subsection (a) is the Governor of the State of Washington, Oregon, Idaho, or Montana, the Governor shall coordinate with the Administrator of the Bonneville Power Administration before making a request under subsection (a).
(c)The authorities established under this subchapter shall terminate on September 30, 2028.

Extension of Termination of Authority Pub. L. 118–42, div. D, title II, § 206(a), Mar. 9, 2024, 138 Stat. 194, provided that: “section 104(c) of the Reclamation States Emergency Drought Relief Act of 1991 (43 U.S.C. 2214(c)) shall be applied by substituting ‘2024’ for ‘2022’.” Similar provisions were contained in the following prior appropriation act: Pub.
