§2425 Operations, Maintenance, and Replacement Costs

Summary
Non-Federal borrowers must cover 100 percent of the running, upkeep, and replacement costs for any project that gets federal help under this law. If the borrower asks, the Secretary can help make a plan for those costs to help the borrower set rates and fees for the people who benefit from the project.

(a)The non-Federal share of operations, maintenance, and replacement costs for a project receiving Federal assistance under this subchapter shall be 100 percent.
(b)On request of the non-Federal borrower, the Secretary may assist in the development of an operation, maintenance, and replacement plan to provide the necessary framework to assist the non-Federal borrower in establishing rates and fees for project beneficiaries.
