The Secretary of the Interior, through the Director of the Bureau of Land Management, does not have to do consultation under any law — including section 7 of the Endangered Species Act (Public Law 93–205; 16 U.S.C. 1536) and 50 C.F.R. §402.16 — for Oregon and California Railroad lands (revested June 9, 1916) and Coos Bay Wagon Road lands (reconveyed February 26, 1919) managed under the Act of August 28, 1937. That exception applies when a land use plan was already adopted on the date a species is listed or critical habitat is designated, and it also covers any provision of that adopted plan. This change does not remove other required consultations. The Secretary must still consult with heads of other federal agencies about projects done or proposed under the Endangered Species Act (including looking at cumulative impacts). The Secretary must also consult when making a new land use plan or making major changes to an existing plan.
