§2809 Limitation on Use of Federal Funds

Summary

Five years after standards are set for each National Geospatial Data Asset data theme under section 2806, a covered agency must not use federal funds to collect, make, buy, keep, or share geospatial data that does not meet those standards, as the Committee decides. Implementation date means the day that is 5 years after those standards are set. If a covered agency gathered, made, or bought the data before the implementation date, it may still use federal money to maintain and share that older, non‑compliant data. The Committee’s Chairperson can grant a waiver if an agency asks at least 30 days before the implementation date and gives reasons, a detailed plan to comply, and the date it will meet the standards. From when the standards are set until the implementation date, agencies must, as much as possible, try to follow the standards.
