Title 43 › Chapter 50— WESTERN WATER INFRASTRUCTURE › § 3204
Money available under section 3201(2)(A) can pay to fix reserved or transferred works only if the work was built on or before January 1, 1915 and a part of it had a critical failure in Bureau of Reclamation infrastructure during the two-year period ending November 15, 2021 that stopped water delivery to project beneficiaries. The funds may be used to rehabilitate, repair, or replace the whole work even if only one project failed, and the money does not have to be paid back to the U.S. government. The Secretary must use money under section 3201(2)(B) to rehab, reconstruct, or replace a dam that meets all these rules: construction began on or after January 1, 1905; it was developed under the Carey Act (43 U.S.C. 641); the State governor has said the dam has reached its useful life, is a significant health and safety concern, and has asked for federal help; and the estimated costs for the work, engineering, and permits would be more than $50,000,000.
