Title 43 › Chapter 50— WESTERN WATER INFRASTRUCTURE › § 3208
The Secretary may, when asked and working with Indian Tribes, States, or public agencies, give technical or financial help and make agreements for groundwater recharge, aquifer storage and recovery, and water‑source substitution projects. The Secretary cannot provide help to build or expand surface water storage. Construction projects must meet the funding rules in section 3202(a)(2)(C)(ii) and cost sharing follows section 3202(b). Projects must follow environmental laws, including the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.), and any project estimated at $500,000,000 or more needs an Act of Congress for construction funding.
