Title 43 › Chapter 9— DESERT-LAND ENTRIES › § 326
After March 28, 1908, people may only enter desert lands under those rules if the land has been surveyed; unsurveyed land cannot be entered. But a person who, before the survey, took possession of a compact tract of up to 320 acres and reclaimed it or in good faith began reclaiming it has priority to enter that land within 90 days after the approved survey is filed in the district land office.
