Title 43 › Chapter 9— DESERT-LAND ENTRIES › § 329
After filing a declaration, and within four years, the applicant must prove to an officer chosen by the Secretary of the Interior that they reclaimed and farmed the land as required, that they are a U.S. citizen, and pay an extra $1 per acre. If they do that, an official ownership patent will be issued to them or to people they transfer it to. No one person or group may hold more than 320 acres of these lands by assignment before the patent is issued, except for entries made or started before March 3, 1891. More proof can be asked for during the allowed time. Claims under sections 321–323, 325, and 327–329 can be challenged like homestead cases for illegal start, abandonment, or failures to follow the law; if proven, the claim and any payments are canceled and go to the United States.
