Title 43 › CHAPTER 12 — RECLAMATION AND IRRIGATION OF LANDS BY FEDERAL GOVERNMENT › SUBCHAPTER I–A — RECLAMATION REFORM › § 390ll
Federal reclamation rules do not apply to land getting water from projects built by the U.S. Army Corps of Engineers, unless one of two things happens: (1) a federal law specifically makes that Corps project part of a Federal reclamation project; or (2) the Secretary has, under reclamation law, provided project works to control or deliver farm water for those lands. If water users have contracts with the Secretary that make them repay their share of construction costs or pay their share of operation, maintenance, and contract administration costs for conservation storage or irrigation storage in a Corps project, those payment duties still must be met.
