The Secretary can give credit for irrigation construction charges when a person who swapped land becomes the one who must pay those charges on the new (lieu) farm, or signs a contract that returns the same amount to the United States. The credit equals the charges that were actually paid on the original farm unit. If an irrigation district in which the lieu farm is located becomes the payer or has a similar contract, the Secretary can give the district the same credit the person received. The Secretary can also lower the repayable construction costs of the old project by amounts assignable to the original farm and lower the costs of the new project by the credit given. When benefits go to an assignee or a resident owner of private land, the same kind of credit can be given to a district.
