Title 43 › Chapter 12— RECLAMATION AND IRRIGATION OF LANDS BY FEDERAL GOVERNMENT › Subchapter VII— EXCHANGE AND AMENDMENT OF FARM UNITS › § 451e
If a person applying to hold an unpatented farm unit on a Federal irrigation project shows the Secretary, by land classification, that the unit cannot support a family, the Secretary may, on terms the Secretary finds acceptable, change the farm unit by adding all or part of other lands on the same project that are open to entry or purchase. The new farm unit cannot be larger than 320 acres total and cannot have more than 160 irrigable acres. Accepting the changed farm unit counts as an exchange under this subchapter, and for resident private land owners covered by section 451a the Secretary may waive, in whole or part, clause (iii) of subsection (b) of section 451a.
