Title 43 › CHAPTER 12 — RECLAMATION AND IRRIGATION OF LANDS BY FEDERAL GOVERNMENT › SUBCHAPTER X — PAYMENT OF CONSTRUCTION CHARGES › § 485g
The Secretary must classify or reclassify lands in a reclamation project for how well they can be irrigated and how productive they are. This can be done from time to time, but not more often than every five years. The work only starts if an organization or authorized water-user representatives ask for it and give the lists and other information the Secretary requires. The Secretary must plan the work to finish it as quickly as reasonable. After a request, the Secretary will make a quick check to see if the work is probably needed. If it looks justified, the Secretary will estimate the cost and the requesting organization must advance one-half of the estimated cost (and one-half of any later supplemental estimates) before work begins. One-half of the expense is charged to nonreimbursable operation and maintenance funds. After the work is done, costs are adjusted so the organization ultimately pays one-half of the actual cost or gets credit if it overpaid. The Secretary may require classification before making certain contracts, and no existing construction-charge obligations can be changed because of a classification unless Congress approves after the Secretary’s report.
