No work may start, no money spent, and no water rights claimed under these rules until the Colorado River Compact is ratified and the President declares it so. If the seven states do not all ratify within six months after December 21, 1928, then work can still wait until six of those states, including California, ratify and waive a special approval rule, the President declares it, and California’s legislature makes a firm, unconditional promise to limit California’s yearly use to 4,400,000 acre-feet of Colorado River water (plus up to one-half of any surplus water) as allowed by the compact. Arizona, California, and Nevada may make a three-state agreement to split the lower-basin 7,500,000 acre-feet so Nevada gets 300,000 and Arizona 2,800,000 acre-feet forever; allow Arizona to use half of any surplus; give Arizona exclusive use of the Gila River inside Arizona; protect Gila water from being reduced by treaty give-aways to Mexico except when extra water beyond surplus must go to Mexico, in which case California and Arizona will each supply half the shortage; agree that none of the three will withhold water or demand deliveries that can’t reasonably be used for homes or farms; and make the agreement follow the compact and take effect when Arizona, California, and Nevada ratify it. Before Congress can fund the dam, power plant, or the main canal to connect Laguna Dam with the Imperial and Coachella Valleys, the Secretary of the Interior must line up contracts or other revenue that, in his judgment, will pay operating and maintenance costs and will repay amounts advanced under section 617a(b), with interest, within 50 years after the works are finished. If, while paying off the debt, the Secretary gets more revenue than needed for the scheduled payments, he must immediately pay 18.75% of that excess to Arizona and 18.75% to Nevada.
