Title 43 › Chapter 15— APPROPRIATION OF WATERS; RESERVOIR SITES › § 666
Allows the United States to be sued as a defendant in cases that decide or manage who may use the water of a river system or other source when the United States owns or is getting those water rights and must be part of the case. The United States gives up claims of immunity, must follow court orders and can appeal like a private person, but the court may not order the United States to pay the other side’s costs. Legal papers must be served on the Attorney General or their representative. This does not let the United States be joined in Supreme Court disputes between States over interstate streams.
