Title 43 › Chapter 22— RIGHTS-OF-WAY AND OTHER EASEMENTS IN PUBLIC LANDS › § 947
To get the benefits of sections 946–949, a canal or ditch company must file a map of its canal, ditch, and reservoir with the land office officer the Secretary of the Interior names. If the land is already surveyed, the map must be filed within twelve months after locating ten miles of canal. If the land is not yet surveyed, the map must be filed within twelve months after the United States surveys it. If the Secretary approves the map, that approval is recorded on the office’s plats and the lands crossed will be handled subject to the right of way. If any person or company, while building a canal, ditch, or reservoir, injures a settler’s possession on public land, the person or company must pay the settler for the injury or damage.
