People, livestock companies, or transport companies that breed, graze, drive, or move livestock may build reservoirs on unoccupied U.S. public lands that are not mineral or otherwise reserved to provide water for animals. They may control the reservoir and up to 160 acres around it so long as the water is kept there, and must follow rules set by the Secretary of the Interior. Reservoirs must not be fenced and must be open for anyone to water animals. The Secretary may allow fencing to protect animals, conserve water, or keep water quality, but the water must still be open to anyone who wants to use it, and any fence must be removed if the Secretary orders.
