Title 43 › Chapter 22— RIGHTS-OF-WAY AND OTHER EASEMENTS IN PUBLIC LANDS › § 961
Lets the head of the federal department that manages public lands give easements (rights to use the land) under general rules they set. These easements can last up to 50 years. They allow lines and poles for electric power and for communications, and structures for radio, TV, and other transmitting, relay, or receiving equipment. Line rights can extend 200 feet on each side of the centerline. Radio and TV sites can be up to 400 feet by 400 feet. Grants can go to U.S. citizens, groups, or corporations. If the route goes through a national park, national forest, military area, Indian reservation, or similar place, the top official in charge of that area must approve and say it does not conflict with the public interest. The department head can cancel a right if it is unused for 2 years or if abandoned. People or companies who already had permits for these uses can get the same benefits under the same terms as new applicants.
