Title 43 › Chapter 23— GRANTS OF SWAMP AND OVERFLOWED LANDS › § 981
If a State’s authorized agent proves to the Secretary of the Interior (or an officer he names) that land bought from the United States before March 2, 1855, was swamp land under the Act of September 28, 1850, the purchase money must be paid to the State where the land is located. If the land was taken by warrant or scrip, the State may pick the same amount of public land open to entry at $1.25 per acre or less and receive land patents. Any decision by that officer must first be approved by the Secretary of the Interior.
