Title 45 › Chapter 21— ALASKA RAILROAD TRANSFER › § 1210
If the Secretary does not certify that the State met the conditions in section 1203 within one year after the report in section 1204(a) was sent, the Secretary may sell or transfer the Alaska Railroad’s property. The sale should favor a buyer who will keep running rail service, but it must not reduce the rights of Cook Inlet Region, Incorporated under section 12 of the Act of January 2, 1976 (Public Law 94–204; 89 Stat. 1150), as amended by section 606(d) of this title, and it must not change the Secretary’s or the State’s consent powers under section 12(b)(8) of that Act, as amended by section 606(d)(5) of this title.
