Title 45 › CHAPTER 16 — REGIONAL RAIL REORGANIZATION › SUBCHAPTER II — UNITED STATES RAILWAY ASSOCIATION › § 720
The Association may sell bonds and other debt to raise money for its work. The Association sets the terms and interest rates, with the Secretary of the Treasury’s approval. The debt can be paid off early or bought back on the open market. All debt outstanding cannot total more than $395,000,000 in principal. No new debt or proceeds may be made after February 5, 1976, except to cover loan commitments made or applied for before January 1, 1976, or to make loans under subsections (g) and (h) of section 721. The Secretary of the Treasury will guarantee payment of principal and interest on any obligations the Association asks to be guaranteed. Those guarantees are backed by the full faith and credit of the United States. If the Treasury lacks cash to meet these promises, the Secretary may issue, buy, sell, or redeem notes or other obligations and treat those actions as public debt transactions. Money may be appropriated as needed to meet these U.S. obligations. The Association’s obligations are legal investments and may be used as security for public and trust funds, and they are exempt from SEC securities laws.
