§31110 Subpoenas to Officers or Members of Crew

Summary

You cannot force an officer or a crew member of a public vessel to appear in a civil case under this chapter unless one of two people agrees: the agency head who controlled the vessel when the claim arose, or the vessel’s master or commanding officer when the subpoena is issued.

An officer or member of the crew of a public vessel may not be subpoenaed in a civil action under this chapter without the consent of— (1)
(2)the master or commanding officer of the vessel at the time the subpoena is issued.
