Last updated Apr 18, 2026|Official source

Summary

Covers certain ships and boats based on size, type, passenger count, and where they travel. It applies to vessels that carry more than 12 passengers under section 2101(31)(A). It also applies to vessels of at least 500 gross tons (measured under section 14302) that are tankers, freight or bulk freight ships, high-speed freight ships, or self-propelled mobile offshore drilling units when they are on a foreign voyage or when a foreign vessel leaves U.S. jurisdiction on a trip that goes onto the high seas. It also covers passenger vessels and small passenger vessels that carry more people than a limit the Secretary sets based on how many could be killed or injured in an accident. Rules under section 3203, including the safety management system rules made on or after the date of enactment of the Elijah E. Cummings Coast Guard Authorization Act of 2020, apply to all covered small passenger vessels as defined in section 3306(n)(5). An owner can ask the Secretary to apply the chapter to a vessel. The chapter does not apply to barges, recreational boats not in commercial service, fishing vessels, vessels on the Great Lakes and connecting waters that are not covered above, or public vessels.
